REGULAR SESSION

December 10, 2001

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, December 10, 2001, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Honorable Scott Perry Jr., President; Donald H. Wilmore, Vice President; and Police Jurors Davron "Bubba" Moreau, Steve P. Bordelon, Ezra L. Reed, Myron K. Lawson, Richard L. Nunnally, Joe Fuller and Richard W. Billings.

Also present were Mr. Tim Ware, Treasurer; Mr. Cecil Raggio, Public Works Director; Ms. Donna Andries, Sales Tax Administrator; Mr. Felix Mouton, WIA Operations Director; Chief David Peart, Fire District No. 2; Mr. Thomas O. Wells, Legal Counsel; Ms. Candice Saucier, Civil Service Director; and Ms. Angie Richmond, Secretary.

Mr. Perry led "My Country 'Tis of Thee".

The invocation was given by Mr. Myron Lawson.

The Pledge of Allegiance was led by Mr. Cecil Raggio.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Scott Perry Jr., President, who welcomed all present and then stated that the Police Jury was ready for the transaction of business.

Mayor Clarence Fields, of the City of Pineville, thanked the Police Jury, particularly Police Jurors Ezra Reed and Steve Bordelon, for the assistance of the Parish Highway Department and Public Works Director Cecil Raggio in the emergency repair of the Susek Drive Bridge, a major thoroughfare in Pineville.

On motion by Mr. Joe Fuller, seconded by Mr. Don Wilmore, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on November 13, 2001, as published in the Official Journal. On vote the motion carried.

On motion by Mr. Joe Fuller, seconded by Mr. Don Wilmore, that approved bills be paid. On vote the motion carried.

On motion by Mr. Joe Fuller, seconded by Mr. Don Wilmore, to accept the Treasurer's Report. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Joe Fuller, to lay over the appointment to the Fire District No. 3 Civil Service Board to fill the expiring term of Mrs. Suzy Berry, term will expire on October 10, 2001, until nominations are received from Louisiana College. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Joe Fuller and Mr. Richard Billings, to reappoint Mr. Calvin Malone to the Ward 10 Recreation District for a five year term, term will expire on January 14, 2007. On vote the motion carried.

The following appointments were announced to be made at the next meeting to:

Ward 6 Recreation District for a five year term to fill the expiring term of Mr. Vance Johnson, term will expire on February 11, 2002;

Buckeye Recreation District for a five year term to fill the expiring term of Mr. Keith R. Harmson, term will expire on February 12, 2002;

Cheneyville Recreation District for a five year term to fill the expiring term of Mr. Moses Barfield, term will expire on February 13, 2002.

On motion by Mr. Richard Billings, seconded by Mr. Joe Fuller, to waive the thirty day announcement rule and reappoint Mr. Vance Johnson to the Ward 6 Recreation District for a five year term, term will expire February 11, 2007, and reappoint Mr. Moses Barfield to the Cheneyville Recreation District for a five year term, term will expire on February 13, 2007. On vote the motion carried.

On motion by Mr. Ezra Reed, seconded by Mr. Joe Fuller, to waive the thirty day announcement rule and reappoint Mr. Keith R. Harmson to the Buckeye recreation District for a five year term, term will expire on February 12, 2007. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Don Wilmore, to thank the voters of Rapides Parish for their confidence in the Rapides Parish Police Jury in approving the tax propositions held on the November 17, 2001 balloting. On vote the motion carried.

The following resolution was offered by Mr. Richard W. Billings and seconded by Mr. Donald H. Wilmore:

RESOLUTION

A resolution providing for canvassing the returns and declaring the result of the special election held in the Sales Tax District No. 3 of the Parish of Rapides, State of Louisiana, on Saturday, November 17, 2001, to authorize the levy of a sales and use tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Sales Tax District No. 3 of the Parish of Rapides, State of Louisiana (the "District"), that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Sales Tax District No. 3 of the Parish of Rapides, State of Louisiana, (the "District"), on SATURDAY, NOVEMBER 17, 2001, to authorize the levy of a sales and use tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

Section 2. Proces Verbal. A Proces Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office, another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.

This resolution having been submitted to a vote, the vote thereon was as follows:

PROCES VERBAL AND PROCLAMATION OF THE CANVASS OF THE VOTES CAST AT THE SPECIAL ELECTION HELD IN THE SALES TAX DISTRICT NO. 3 OF THE PARISH OF RAPIDES, STATE OF LOUISIANA, ON SATURDAY, NOVEMBER 17, 2001.

BE IT KNOWN AND REMEMBERED that on Monday, December 10, 2001, at three o'clock (3:00) p.m., at its regular meeting place, the Rapides Parish Courthouse, 701 Murray St., 2nd Floor, Alexandria, Louisiana, the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Sales Tax District No. 3 of the Parish of Rapides, State of Louisiana (the "District"), and being the authority ordering the special election held therein on Saturday, November 17, 2001, with the following members present:

SALES TAX DISTRICT NO. 3

(1/2% SALES TAX RENEWAL)

SUMMARY: 5 YEAR 1/2% SALES TAX RENEWAL FOR CONSTRUCTING AND MAINTAINING PUBLIC STREETS, ROADS, HIGHWAYS, BRIDGES AND DRAINAGE IN THE PARISH AND FOR PAYING GENERAL OPERATING EXPENSES, AND SALARIES OF EMPLOYEES IN CERTAIN MUNICIPALITIES

Shall Sales Tax District No. 3, Parish of Rapides, State of Louisiana (the "District"), consisting of the entire area within Rapides Parish outside the corporate limits of Alexandria and Pineville, under the authority of R.S. 33:2721.6 be authorized to continue to levy and collect within the District, and adopt an ordinance providing for such levy and collection, one-half of one percent (1/2%) tax upon the sale at retail, the use, the lease or rental, the consumption and the storage for use or consumption of tangible personal property and upon the sale of services within the District, all as presently or hereafter defined in R.S. 33:1721.6 and R.S. 47:301-317, inclusive, for five (5) years, said tax to constitute a renewal and continuation of a similar tax, which expires on May 31, 2002, with the avails or proceeds of the tax (after paying reasonable and necessary costs and expenses of collection and administration) to be allocated and divided between the Parish and the incorporated municipalities in the Parish on the following percentage basis:

(i) 4.91% to Town of Ball

(ii) 1.99% to Town of Boyce

(iii) 1.47% to Town of Cheneyville

(iv) .62% to Village of Forest Hill

(v) 2.50% to Town of Glenmora

(vi) 2.33% to Town of Lecompte

(vii) .37% to Village of McNary

(viii) 1.10% to Village of Woodworth

(ix) 84.71% to Rapides Parish Police Jury as the

(x) 100% parish governing authority

and shall the percentage of tax revenues allocated to each municipality and parish listed above be reallocated annually in July based upon the most recently published Federal/State Cooperative population estimate by and between the U.S. Census Bureau and Louisiana Tech University to reflect new and dissolved municipalities, and population changes and shall the aforesaid political subdivisions dedicate and use the tax avails or proceeds of their respective allocations of the said tax for the following purposes:

(a) In the Parish, for constructing and maintaining public streets, roads, highways, bridges and drainage; and

(b) In the municipalities, for paying general operating expenses, and salaries of municipal employees?

There was found by said count and canvass that the following votes had been cast at the said special election IN FAVOR OF and AGAINST, respectively, the proposition as hereinabove set forth at the following polling places, to-wit:

MAJORITY FOR 673

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there was a total of 1,049 votes cast IN FAVOR OF the Proposition and a total of 376 votes cast AGAINST the Proposition, as hereinabove set forth, and that there was a majority of 673 votes cast IN FAVOR OF the Proposition as hereinabove set forth.

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the District on Saturday, November 17, 2001.

PROCLAMATION

I, the undersigned President of the Police Jury of the Parish of Rapides, State of Louisiana, the governing authority of the Sales Tax District No. 3 of the Parish of Rapides, State of Louisiana (the "District"), do hereby declare, proclaim and announce that the proposition submitted at the special election held in the District on Saturday, November 17, 2001, was CARRIED by a majority of the votes cast at the said special election, all as described and set out in the above Proces Verbal.

The following resolution was offered by Mr. Richard W. Billings and seconded by Mr. Donald H. Wilmore:

RESOLUTION

A resolution providing for the examining and counting of the votes, examining and canvassing the returns, and declaring the result of the special election held in Fire Protection District No. 8 of the Parish of Rapides, State of Louisiana, on November 17, 2001, for the purpose of submitting to the voters of said district a proposition respecting local option in said district.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of the Fire Protection District No. 8 of the Parish of Rapides, State of Louisiana:

SECTION 1. That this Police Jury does now proceed in open and public session to open the envelopes containing the official tabulations of the votes cast at the special election held in Fire Protection District No. 8 of the Parish of Rapides, State of Louisiana, on Saturday, November 17, 2001, to authorize the levy of a special tax therein, said tabulations having been prepared and certified by the election officials serving at the election polls and this Police Jury does now further proceed to examine, count and tabulate such votes and to examine and canvass the returns and declare the results of said election.

SECTION 2. That a Proces Verbal of the canvass of the returns of said election shall be made and that a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; that another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, State of Louisiana, who shall record the same in the Mortgage Records of said Office; and that a copy thereof shall be retained in the archives of the Police Jury.

SECTION 3. That the results of the said election shall be promulgated by publication in the manner provided by law.

BE IT KNOWN AND REMEMBERED that on Monday, December 10, 2001, at three (3:00) o'clock p.m., at its regular meeting place, the Police Jury Room of the Courthouse, Alexandria, Rapides Parish, Louisiana, acting as the governing authority of Fire Protection District No. 8 of the Parish of Rapides, State of Louisiana, and being the authority ordering a special election held in said district on Saturday, November 17, 2001, with the following members present:

Scott Perry Jr., Donald H. Wilmore, Davron "Bubba" Moreau, Steve P. Bordelon, Ezra L. Reed, Myron K. Lawson, Joe Fuller, Richard L. Nunnally, and Richard W. Billings

FIRE PROTECTION DISTRICT NUMBER 8

SUMMARY

10 YEAR 40 MILL PROPERTY TAX FOR CONSTRUCTING, OPERATING AND MAINTAINING FIRE PROTECTION FACILITIES AND PAYING THE COSTS OF OBTAINING WATER FOR FIRE PROTECTION PURPOSES IN FIRE PROTECTION DISTRICT NUMBER 8

PROPOSITION

Shall Fire Protection District Number 8 of the Parish of Rapides, State of Louisiana, levy and collect a special ad valorem tax of forty (40) mills on each dollar of assessed valuation on all the property subject to taxation in said District for a period of ten (10) years, beginning with the year 2003 and ending with the year 2012, for the purpose of acquiring, constructing, improving, maintaining or operating fire protection facilities, vehicles and equipment, including both movable and immovable property, that are to be used to provide fire protection in the District?

There was found by said count and canvass that the following votes had been cast at the special election in favor of, and against, respectively, the proposition as hereinabove set forth, to-wit:

NUMBER OF VOTES FOR PROPOSITION 71

NUMBER OF VOTES AGAINST PROPOSITION 23

It was therefore shown that there was a majority of 48

votes cast IN FAVOR OF the proposition as hereinabove set forth.

Therefore, in accordance with the result of the canvass of the returns and action of the Police Jury of the Parish of Rapides, State of Louisiana, I, Scott Perry Jr., President of said Police Jury, do hereby proclaim, declare and announce the said proposition as hereinabove set forth to have duly CARRIED by a majority of the votes cast by the qualified electors voting at said special election held in said District on Saturday, November 17, 2001.

On motion by Mr. Joe Fuller, seconded by Mr. Richard Billings, the following ordinance was presented levying the 1/2% sales tax in Sales Tax District No. 3, effective June 1, 2002, as approved by the voters on November 17, 2001, and as recommended by the Sales & Use Tax Director, and on vote unanimously adopted:

ORDINANCE

AN ORDINANCE TO AMEND AND REENACT SECTIONS 23-22 THROUGH 23-22.3 SALES TAX DISTRICT NO. 3 SALES AND USE TAX UNDER THE RAPIDES PARISH CODE OF ORDINANCES SO AS TO CONTINUE THE LEVY FOR THE SALES TAX DISTRICT NO. 3 PROPOSITION AS APPROVED BY THE VOTERS ON NOVEMBER 17, 2001, AND TO PROVIDE FOR RELATED MATTERS.

BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 10th day of December, 2001, that Sections 23-22 through 23-22.3 of the Rapides Parish Code of Ordinances is hereby amended and reenacted as follows:

Chapter 23. Taxation and Licenses

Article III. Sales and Use Tax

Part A. Propositions

Section 23-22. Sales Tax District No. 3 sales and use tax - Proposition.

Shall Sales Tax District No. 3, Parish of Rapides, State of Louisiana (the "District"), consisting of the entire area within Rapides Parish outside the corporate limits of Alexandria and Pineville, under the authority of R.S. 33:2721.6 be authorized to levy and collect within the District, and adopt an ordinance providing for such levy and collection, one-half of one percent (1/2%) tax upon the sale at retail, the use, the lease or rental, the consumption and the storage for use or consumption of tangible personal property and upon the sale of services within the District, all as presently or hereafter defined in R.S. 33:2721.6 and R.S. 47:301-317, inclusive, for five (5) years, said tax to constitute a renewal and continuation of a similar tax, which expires on May 31, 2002, with the avails or proceeds of the tax (after paying reasonable and necessary costs and expenses of collection and administration) to be allocated and divided between the Parish and the incorporated municipalities in the Parish on the following percentage basis:

Section 23.22.1. Same-Imposition of tax rate; levy.

There is hereby levied from and after June 1, 2002, for the purposes stated in the proposition set forth in the resolution adopted on March 19, 2001, and approved by the voters on November 17, 2001, a tax upon the sale at retail, the use, the lease or rental, the consumption and storage for use or consumption of tangible personal property and on sales of services within Sales Tax District No. 3, as defined herein, and the levy of such tax shall be as follows:

(a) At the rate of one-half (1/2) of one (1%) per cent of the sales price of each item or article of tangible personal property when sold at retail in Sales Tax District No. 3; the tax to be computed on gross sales for the purpose of remitting the amount of tax due the taxing authority, and to include each and every retail sale.

(b) At the rate of one-half (1/2) of one (1%) per cent of the cost price of each item or article of tangible personal property when the same is not sold, but is used, consumed, distributed, or stored for use or consumption in Sales Tax District No. 3; provided there shall no duplication of the tax.

(c) At the rate of one-half (1/2) of one (1%) per cent of the gross proceeds derived from the lease or rental of tangible personal property, as defined herein, where the lease or rental of such property is an established business, or part of an established business or the same is incidental or germane to the said business.

(d) At the rate of one-half (1/2) of one (1%) per cent of the monthly lease or rental price paid by lessee or rentee, or contracted or agreed to be paid by lessee or rentee to the owner of the tangible personal property.

(e) At the rate of one-half (1/2) of one (1%) per cent of the gross proceeds derived from the sale of services, as defined herein.

Section 23-22.2. Same-Taxing District.

The taxing district for this proposition is Sales Tax District No. 3 of the Parish of Rapides, State of Louisiana, which consists of the entire area of Rapides Parish, except the area within the municipalities of Alexandria and Pineville.

Section 23-22.3. Same-Applicability of parish sales and use tax code.

The provisions of the Rapides Parish Sales and Use Tax Code {sections 23-25 (1.00) through 23-37 (13.03)} are applicable to the imposition of tax, rate, levy and collection of the sales and use tax as defined in the foregoing proposition.

BE IT FURTHER ORDAINED that this ordinance is to be effective June 1, 2002.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, the following resolution was presented, as recommended by the Public Works Director, and on vote unanimously adopted:

RESOLUTION

WHEREAS, the Rapides Parish Police Jury has been a participant in the Federal/State Off System Bridge Replacement Program since its beginning; and,

WHEREAS, the Rapides Parish Police Jury has always complied with all Federal and State regulations; and,

WHEREAS, this Police Jury desires to continue to participate in the Off System Bridge Replacement Program,

NOW, THEREFORE, BE IT RESOLVED the Rapides Parish Police Jury does hereby express its desire and intent to participate in the Off System Bridge Replacement Program;

BE IT FURTHER RESOLVED that Mr. Cecil Raggio, Parish Public Works Director, is hereby redesignated as the representative of the Rapides Parish Police Jury responsible for implementation of the Louisiana Department of Transportation and Development Off System Bridge Replacement Program;

BE IT FURTHER RESOLVED that the Rapides Parish Police Jury does hereby assure the Department of Transportation and Development, State of Louisiana, that said Police Jury will comply with the Uniform Relocation Assistance and Real Property Acquisition Policies Act, as amended (Uniform Relocation Act), 42 U.S.C. 4601-4655, and with implementing Federal regulations in 49 C.F.R. Part 24, all pertaining to land acquisition for right of way purposes;

BE IT FURTHER RESOLVED that this Police Jury will comply with the Real Estate Section's 3.2.0.0, 4.1.1.0-4.3.3.0, 5.1.1.1-5.3.2.3 and 5.5.1.1.;

BE IT FURTHER RESOLVED that the President is authorized to sign a letter of assurances of compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act and applicable LDOTD policies.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to waive the forty foot culvert limitation and authorize the Parish Highway Department to install approximately 200 feet of 18 inch culverts at 69 Schoolhouse Road for Mr. Paul Squyres, the property owner to furnish the culverts and the one catch basin and the Parish Highway Department to install and backfill. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to authorize the expenses of interested Police Jurors who attended the Louisiana Task Force meeting held on November 30, 2001 in Baton Rouge in conjunction with the Police Jury Association's concerns of the Parish Transportation Fund, Rural Development and Off-System Bridge Program. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to waive the forty foot culvert limitation and authorize the Parish Highway Department to install approximately 60 feet of 18 inch culverts at 515 Azalea Avenue, Ward 11, District C, for Mr. Brian Sullivan, the property owner to furnish the culverts and the catch basins and the Parish Highway Department to install and backfill. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to authorize to enter into an Intergovernmental Agreement with the Town of Glenmora for the Parish Highway Department to use inmate labor in the amount of 40 hours for the purpose of cleaning out ditches within corporate limits, as requested by Mayor Tyrone Doyle, and authorize the President to sign same. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to reject Bid No. 1798 Mowing of Parish Roadside Rights of Way because sufficient funds are not available to award this project, as recommended by the Public Works Director. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to authorize to advertise for bids to purchase three 6- to 8-yard dump trucks for the Highway Department, to be paid out of the Road and Bridge Funds. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to authorize to purchase six 1/2-ton pick-up trucks and one large sedan under the City of Alexandria's Bid No. 1330 for the Highway Department, to be paid out of the Road and Bridge Funds. On vote the motion carried.

On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, to purchase five tractors and five mowers under the Louisiana State Contract for the Highway Department, to be paid out of the Road and Bridge Funds. On vote the motion carried.

On motion by Mr. Myron Lawson, seconded by Mr. Joe Fuller, to authorize the Rapides Area Planning Commission to submit an application for a grant under the Flood Mitigation Assistance Grant Program and authorize the President to sign the application and related documents. On vote the motion carried.

On motion by Mr. Myron Lawson, seconded by Mr. Joe Fuller, to authorize Intergovernmental Agreements with each of the municipalities in the Parish for a study of the flood maps and to authorize the President to appoint a committee to prioritize the areas in the Parish that needed to be studied, to be composed of either the Police Jurors or their representatives. On motion by Mr. Richard Nunnally, seconded by Mr. Richard Billings, the following resolution was presented to endorse Copeland Restaurant as a participant in the benefits of the Louisiana Enterprise/Economic Development Zone Program in Tract 126 Block Group 4 in Rapides Parish with rebate from the 1% Rapides Parish Police Jury Sales and Use Tax, and authorize the President to sign the Certificate of Endorsement:

ENDORSEMENT RESOLUTION

RESOLUTION STATING THE RAPIDES PARISH POLICE JURY'S ENDORSEMENT OF COPELAND RESTAURANT TO PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM

WHEREAS, the Louisiana Enterprise Zone Act 901 of 1981, Act 337 of 1982, Act 433 of 1987, Act 1024 of 1992, Act 581 of 1995 and Act 647 of 1997; and,

WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development to some of the most distressed areas in the Parish of Rapides; and,

WHEREAS, the Louisiana Department of Economic Development designated Census Tract 126 Block Group 4 in Rapides Parish, as an "Enterprise Zone" eligible based on enabling legislation (R.S. 51:1781-1791); and,

WHEREAS, the Rapides Parish Police Jury states this endorsement is in agreement with the Overall Economic Development Plan for Rapides Parish; and,

WHEREAS, the attached Enterprise Zone map is marked showing the location of the business being endorsed; and,

WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements, the Rapides Parish Police Jury agrees:

1. To participate in the Enterprise Zone Program.

2. To assist the Department in evaluating progress made in any Enterprise Zone within its jurisdiction.

3. To REBATE all applicable (applicable sales/use taxes are defined as all local sales/use taxes except those that are dedicated to the repayment of a Bond issue or dedicated to any public school) local sales/use taxes on the purchase of eligible construction materials, machinery, and equipment purchased for this project and used by the business permanently on that site.

BE IT RESOLVED by the Rapides Parish Police Jury in due, regular and legal session convened this 10th day of December, 2001, that COPELAND RESTAURANT and their project SMALLTOWN COPELAND'S, Enterprise Zone Application No. 20010410, is endorsed to participate in the Louisiana Enterprise Zone Program.

BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of the resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.

BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

AN ORDINANCE ADOPTING THE OPERATING BUDGET AND REVENUES AND EXPENDITURES FOR CERTAIN FUNDS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2002, AND ENDING DECEMBER 31, 2002, IN ACCORDANCE WITH LA R.S. 39:1309-1310.

BE IT ORDAINED by the Police Jury of Rapides Parish, in regular session convened that:

SECTION 1. The following estimate of revenues for certain funds for the fiscal year beginning January 1, 2002, and ending December 31, 2002, be and the same is hereby adopted to serve as an Operating budget of Revenues for these funds for the Police Jury of Rapides Parish, during the same period.

SECTION 2. The attached estimates of expenditures for certain funds is hereby adopted to serve as a budget of expenditures for these funds for the Police Jury of Rapides Parish during the same period.

SECTION 3. The adoption of this operating budget of expenditures be and the same is hereby declared to operate as an appropriation of the amount therein set forth within the terms of the budget classification.

SECTION 4. Amounts are available for expenditure only to the extent included within the 2002 budget.

SECTION 5. The Treasurer shall have the authority to make any changes and amendments to any agencies, departments, functions, characters and funds within the adopted budget as he deems necessary provided that the provisions of LA R.S. 39:1310 (A) are followed.
